The Health and Human Services Department has issued a rule that bans any nursing home that receives federal funding from requiring residents to resolve legal disputes in arbitration, instead of court. The nursing home industry has expressed concerns about significant cost increases and subsequent potential nursing home closures. While this new rule can still be challenged, it is scheduled to go into effect in November.
